Terms & conditions
Agreement/Jurisdiction:
The person(s) whose signature(s) appear on this contract, known as "Client", agrees that (KATE ORGERA PHOTOGRAPHY LLC) Name known as "Photographer", shall provide services to photograph their wedding events to the best of her abilities, in the manner described in this document. This is a binding contract which incorporates the entire understanding of the parties, and any modifications must be in writing, signed by both parties, and physically attached to the original agreement. Client assumes responsibility for all collection costs and legal fees incurred should enforcement of this contract.
Liability:
If Photographer or his agent (2nd shooter) is unable to perform any or all of the duties herein for any reason, including but not limited to, fire, transportation problems, accident, illness or technical problems and he cannot provide another competent professional, all money received by Photographer, minus expenses, will be returned to Client, and Photographer shall have no further liability with respect to this agreement.
Method of Cancellation:
In the event of a canceled or rescheduled wedding, (KATE ORGERA PHOTOGRAPHY LLC) requires a notification in writing prior to the original wedding date. This is the only method of cancellation I will accept. The down payment is non-refundable in any case of cancellation.
Over time:
On the noted wedding date, the number of hours offered is meant to begin when the photographer walks into the first venue and ends when they complete breakdown at the last location. All overtime will be billed and is to be paid at the overtime rate of ($250) per hour.
Completion Schedule:
Editing and uploading to an online gallery creation takes six to eight weeks. If completion will take any longer than eight weeks,(KATE ORGERA PHOTOGRAPHY LLC) will notify the client as soon as possible. Client accepts all responsibility for archiving and protecting the photographs. Photographer is not responsible for the lifespan of any digital media provided or for any future changes in digital technology or media readers that might result in an inability to read discs provided. It is Client's responsibility to make sure that digital files are copied to new media as required.
RAW Images:
(KATE ORGERA PHOTOGRAPHY LLC) will not give out Raw and/or unedited images. If it is for printing please ask for assistance.
Meals:
if (KATE ORGERA PHOTOGRAPHY LLC) is shooting more than six hours she must be provided a meal at the reception.
Payments:
A retainer fee of half of the collection amount is due at the time of booking; this payment is non-refundable and must be paid in order to secure your event day. Last half needs to be paid a week before the event day unless otherwise agreed upon. If not paid in full by the event day, (KATE ORGERA PHOTOGRAPHY LLC) has the right to not show up to photograph the event.
Late Payments:
For whatever reason if the client has not paid the photographer the agreed amount by a certain date there will be late charges for every week the payment is late. If all payments have not been made at the end of six months from the noted wedding day, (KATE ORGERA PHOTOGRAPHY LLC) has the right to delete images without having to refund any monies to the client.
Creative Control:
(KATE ORGERA PHOTOGRAPHY LLC) will keep all RAW images taken during an event and will give clients the completed edited copies. (KATE ORGERA PHOTOGRAPHY LLC) has the right to photograph in her own photographic style as displayed on Facebook, Instagram, and on her website. Clients are free to suggest any poses or ideas.
Ownership:
Upon payment in full to (KATE ORGERA PHOTOGRAPHY LLC) of all amounts due to (KATE ORGERA PHOTOGRAPHY LLC), ownership and possession of the digital images will be given to you. (KATE ORGERA PHOTOGRAPHY LLC) will share the copyright of photographs taken on the noted wedding date as samples of the photographers work, for the purposes of window and showroom exhibits, advertising including printed publications, professional competition, editorial control and the world wide web.
Injury/loss:
The noted party agrees that (KATE ORGERA PHOTOGRAPHY LLC) shall not be liable for any personal injury, loss or damage to property occasioned by any act or omission of the photographer(s).
Sole Photographer:
Photographer shall be the sole professional photographer at the event. Photographer may bring a 2nd shooter or assistant with letting the client know beforehand. Client acknowledges that the presence of Other Photographers will adversely impact the ability of the Photographer to create the Work and as a result, the Work may fail to meet the standards represented by the Studio in its portfolio and samples.
Refund Policy:
The noted party acknowledges and agrees that the liability of (KATE ORGERA PHOTOGRAPHY LLC), its photographers, no matter howsoever caused, is limited to the following refund policy:
If (KATE ORGERA PHOTOGRAPHY LLC) is unable to supply the noted party with any photos from any coverages due to circumstances beyond its immediate, direct, and reasonable control, including but without limiting the generality of the foregoing, due to digital film defect, camera or flash or lighting malfunction, then (KATE ORGERA PHOTOGRAPHY LLC) will give the noted party a refund for the amount paid for the affected coverages.
If the photographers do not meet the noted party's reasonable expectations, and if the same arises solely and exclusively because the photographers failed to perform their services in a reasonably competent manner under the circumstances given to them, then (KATE ORGERA PHOTOGRAPHY LLC) will give the noted party a partial refund for the affected coverages in an amount determined by (KATE ORGERA PHOTOGRAPHY LLC), acting reasonably, but in no event to exceed the amount paid for the affected coverages.
100% (one hundred percent) of the payments paid are forfeited if this Wedding Photography Contract is broken, canceled or terminated prior to and including the noted wedding date. I have read, understand and agree to the terms and conditions of this Agreement. Each person signing as Client below shall be fully responsible for ensuring that full payment is made pursuant to the terms of this Agreement.
